If the FDA can’t ban “e-cigarettes” then why does the DEA get to ban marijuana inhaled via a vaporizer?
Question by _______: If the FDA can’t ban “e-cigarettes” then why does the DEA get to ban marijuana inhaled via a vaporizer?
A) If marijuana is considered a “drug” (as opposed to a “natural plant”) then why isn’t the proven beyond a shadow of a doubt addictive nicotine not also considered a drug?
B) The description of this e-cigarette product sounds VERY similar to the way some people consume marijuana now: “battery-powered products that allow users to inhale nicotine vapor (insert THC vapor here) without fire, smoke, ash, or carbon monoxide”
If the logic for allowing nicotine products to be sold is that they are derived from a “natural plant” then how the hell is marijuana still illegal? Why does the FDA regulate cigarettes, yet the DEA bans marijuana?

WASHINGTON (Reuters) – The Food and Drug Administration can only regulate “e-cigarettes” as tobacco products and not as drugs, and thus cannot block their import, a U.S. appeals court ruled on Tuesday.
The ruling by three judges of the U.S. Court of Appeals for the D.C. Circuit infuriated tobacco activist groups and will allow e-cigarette maker Sottera Inc. to start importing its NJOY products.
“Electronic cigarettes are battery-powered products that allow users to inhale nicotine vapor without fire, smoke, ash, or carbon monoxide,” the court said in its ruling.
“The liquid nicotine in each e-cigarette is derived from natural tobacco plants.”
